I worked on an L1b in the US for 4 years. Because my company wouldn't sponsor me for a green card, I decided to switch to another company that offered to sponsor me for permanent residency and employ me in Europe in the meantime. Unfortunately, the PERM was audited and the legal entity that applied for the PERM is being dismantled as the result of an acqusition.
As a next step, the company could sponsor me for an L1 (not sure if L1a is possible, otherwise L1b) or an H1, but it's unlikely they'll sponsor me again for a green card soon. I also have an offer from another company, who'd offer to sponsor me for an H1 and possibly for a green card later on.
Since my spouse has a green card (same sex couple, therefore no family green card possible), I would very much like to return to my home in the U.S.
Which one is the safer option - L1x + H1 or H1 + green card? I have two bachelor degrees and 13 years of specialized experience but no masters degree. Any other advice for my situation?

Hi,
company A did H1B and H4 (both approval notices. No Visas stamped yet)
company B is doing H1b only. Can the dependent candidate stay on company A's sponsored H4 approval ?

No need to file H4 till her current H4 expires. As long as you are maintaining continuous H1 status (without gaps), H4 would remain active till its current validity even if primary H1 applicant changes jobs. You can file her H4 extension of stay petition 90 days in advance from the current H4 expiration date.

I have a quick question about PERM requirements. I was told by my attorney that if I own my company�s stocks, I will be considered a part owner of the company and this will automatically trigger an audit.
My company is a private company and I was given some stock options with very few stocks that I have exercised. I will really appreciate your response.

I dont think so. These options are a portion of the employee benefits. You pay tax for these when you exercise them. By holding a share you are only investing in that company you have certain rights as a share holder but not enough to be considered an owner (like a restaurent owner for example). Also how is the CIS going to be aware or be concerned about this? Consult another attorney if you are so worried. Your attorney might be over concerned or misinformed.

Hello All,
I am in a strange situation.
My attorney is about to file my I-1485 this week.
My details:
Previous company:
Perm PD: June 2006 EB2
I-140 EB2 approved in Nov/2006.
Current company:
PERM filed: Oct/24/2007
I-140 EB2 filed on Jan/31/2008
trying to recapture the old PD of June/2006.

Everybody please post the names of attorneys who are easy / not easy, safe / not safe to deal with. People can post the names of the attorneys and a brief description (without specifics) about the problems / happy endings, they encountered. This could become an excellent review post for immigration lawyers. we could also maybe put 3 or 4 criteria to score them from 1 to 4. for eg:-
availability to answer questions
timely filing
acurate filing (with all documents)
current with legal provisions and latest changes
overall easiness to work with
cost
etc etc
Experts pls join in to fix the scoring pattern. We need to know the crooks and the good samaritarians out there.

IV needs volunteers
As the time approaches for heated immigration debate on the Hill, behind the scenes IV activities are also are also going to increase. IV core members have full time jobs and thus we need more hands to share the mission we have all been working on.
This is a request to IV members if they are willing to spare a few hours everyday for some IV's work. This work will involve writing lots of emails (a template will be provided) and making phone calls.
We all are going through a lot of frustration due to the delays in our green card processes and I am sure highly skilled and educated spouses that are on H4 would have more than our share of pain due to not having any work permit. If we could have such volunteers who can devote few hours during the day for IV it would a Big help. With everyone's effort and support we will surely succeed.

I have used AC21 twice. I did send a letter to USCIS for my first move. i have not sent any letter for my second move. Most of the attorneys i consulted are saying it is not necessry to file for AC 21 unless you feel the employer can jeopardise your green card.
There is no rule for filing AC 21. If you get an RFE, they will request the specific document they need. If you are following the rules, then you should be able to provide whatever they request in the RFE.

You can use either the current edition of 06/05/2008 since that's the version on USCIS web site or use the older version until July 31, 2008. From August 1, 2008 you MUST use the 06/05/08 edition only. I am sure your doctor will have the older edition.

Hi,
I have spent over 3 years in US. Can I file for H1B extension based on 6 years window for H1B visa. My situation is I am in India and the company is filing this fro me in US.
What are the chances of getting this extension approved?
1. I have maintained a legal status for 3 years during my stay in US.
2. 221g was the problem I couldnt get back to States.
3. 221g got cleared but my I 797 got expired and old company withdrew H1B extension.
4. Now one company is helping me with H1B extension based on my case as detailed above.
Pls advice about the possibility of getting this H1B extension. I am kind of waiting on this for long.

Hi,
I need some good advice on what to do next in my situation.My 1st 3 Yr H1B comes to an end in April and i have another 3 years left in my H1B. Recently in dec i got my I-140 EB3 approved and my 485 is pending PD JAN 2005. I applied for EAD for my wife in july and she got it in sept. I am confused about what to do next? Whether apply for H1B renewal or apply for EAD or apply for both as a safer side ?
If i get apply for EAD only, if something goes wrong with I-485, can i apply for H1B and get back to H1-B status?
How useful will it be to apply for both H1B and EAD? If i apply for both, and work on my EAD, Will i still lose the time left on my H1B?

With the recent implementation by U.S. Citizenship and Immigration Service (USCIS) allowing concurrent filing of Form I-360 Religious Worker Petition and Form I-485 Adjustment of Status Application, most applicants want to know what documents to submit with an adjustment of status (AOS) application.
Persons with a pending I-360 religious worker petition are now eligible to file an AOS application before September 9, 2009. The AOS application is used by persons who are in the United States to apply with USCIS to adjust to permanent resident status.
Along with the Adjustment of Status Application on Form I-485, one must remember to submit:
a copy of the I-360 receipt notice,
two passport style photos,
a copy of the applicant’s passport,
a copy of the applicant’s birth certificate (along with a certified English translation if the document is not in English), and
a medical examination report performed by a designated civil surgeon.
If an AOS applicant has ever been arrested then a court-certified copy of all arrest records and the final disposition of the case is required (excluding traffic tickets).
Individuals between the ages of 14-79 are also required to submit a Biographic Information Sheet on Form G-325A.
The most important thing to remember before sending the AOS application is the filing fee! Do NOT forget to submit a check or money order to the U.S. Department of Homeland Security in the amount of $1010. No additional fee is required for Form I-765 Employment Authorization Application and for Advance Parole on Form I-131 if filing with an AOS application.

Can you at least produce the extension receipt at the embassy? Is your job title IT Consultant? If the answers are no and yes, personally I would not risk it. Of course this is nothing more than a personal opinion. My H-1B expires in April. I waited for the past 3 months and got my extension approved so I'm going back to China this month.
