Guys,
I am currently working as Programmer Analyst for a company who is currently doing the GC. I have been with them for about 7 years.
Starting next month I am going to use my H1 7th year.
I am pondering about a new offer Firmware Engg. My GC detaisl are below:
PD: 06/2003 -- EB3
Education: MS
I am planning to stay in H1B, if possible with the new employer. But thinking of doing PERM and see if I can port my earlier date during I-140 filing.
Any suggestions or recommendations ...

I had a RFE against my I-485 in last week of Nov 07. It was for medical exam, doc forgot to check one box :(
Now the RFE has been replied to and USCIS should hopefully have no further questions on my application. But now the issue is retrogression of EB2 India back to Jan 02 (while I am Jun 03). So does that mean though my application could be cleared by the immigration officer, it will still be put back on shelf because of the retrogression in Dec 07 ?

Hello everybody,
My wife who is on H4 was denied admission to a masters in accounting program due to lack of work experience. Other factors (GPA/GMAT scores) were allright according to a professor at the university! Does anybody know how/where she can get some experience (voluntary/unpaid/intership). We have already looked at craigslist job listing in the non-profit sector and not many people are looking to hire even if its unpaid:eek: We reside in Raleigh/NC and was wondering if someone in this forum has some insight as to how we can move forward.

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Thanks in advance for your response."

I am in a little bit of a strange situation and wanted to know what my options are.
Just started 8th year of H1 (have approved visa + stamp upto 10th year).
Am considering switching jobs mainly because my current one is too frustrating.
Found another offer I like but they do not have an immediate requirement but want me to start 3 months from now. They are, however, willing to have me start earlier and work for a week or so and then go on a leave of absence for a month or so. I also would find the one month break useful to go to India and deal with some family issues.
I would apply for my H1 transfer and actually switch only after it is approved.
Does anyone see any issues with this? ie., going on an unpaid LOA outside the country, especially in a new job. Would there be any issues while coming back at port of entry?
Any advice/feedback would be appreciated.

I planning to change my employer after 180days and I want go for the fulltime by using my EAD because my I-485 will take next 3 or 4 years (PD May-2007). My present H1 is still Oct 2008 (labor and I-140 cleared).
1. What are the chances for rejecting my I-485 file?
2. If my I-485 file rejected after my H1 expired (EAD using) ?
3. How to settle out this ? Do I need to go back india?

When i travelled using AP i had Just One copy and when IO asked for rest i said they are with the attorney.
The IO said i should carry all AP copies and can reuse the one which is stamped.

It wouldn't hurt your GC process or your status even if your employer revokes your approved I-140. If you are so worried then check this info from USCIS - http://www.uscis.gov/files/pressrelease/I140_AC21_8403.pdf

I have applied for H1B transfer and here is my situation.
H1B expiration date with ex employer was 06/10/2010 and I transferred the H1B to a new employer on 06/01/2010 and the approval came on 08/09/2010. However the approval notice says the validity date is from 08/02/2010 to 08/01/2011. It should have been 06/11/2010 because we filed this transfer before the expiration date.
We sent an inquiry but the officer was saying the application was submitted based on new employment and not continuation of previously approved employment without change with the same employer, so we will not change our decision.
What should I do? I think I was out of status from 06/11 to 08/01. Does anyone have any information?

I'm sorry, but I certainly won't be taking the time to wade through a gallery of hundreds of images that look almost exactly the same, let alone writing critiques for each one (which is what I assume you were asking for, having posted your site in this particular forum).

I got my EAD renewed recently and by mistake I have interchanged my First Name and Last Name in the application. I received an approved EAD card also with the First Name and Last Name interchanged.
I noticed the problem only when I went to renew my Drivers License.
My questions are
1) What is the process to get the names rectified on an approved EAD
2) If I leave it as it, will it create any issues.

I am sure there are several other legal immigrants donations to the US hospitals, Colleges and Universities etc.
I am sure that if we can link those all in one thread and later on can be compiled by IV to make strong point that Legal immigrant apart from generating lots of jobs and economical growth for US also contribute generously to various progressive causes, by the wealth that they make because of their creative mind and skills.
On other hand there is a debate about undocumented workers relying on the US tax payers resources.
