• If I don’t work for my current employer for at least six months after the approval, what kind of issues comes up when applying for citizenship later. What is the law.

I am 25 yrs old. I have a green card since 2004. i did a stupid mistake by commiting a theft from a mall of less than 90 bucks in 2005. i pleaded guilty and i was sentenced one year suspended with probation (Didn't serve time) and some hours community service. At first it was a felony since it included a tool to remove a sensor. but then it was reduced to a misdemeanor. I have been good with the law ever since. I went to school have AA and bachelor degree in international business, I have my own business, pay taxes, so on and so forth.
Now I would love to be American citizen but i am afraid when they pull up my record they will see i am deportable. It has been almost 6 years but I am afraid i will be rejected. My green card expires on 2014. Any response is greatly appreciated.

and also im thinking of just renewing my green card. ( would that be rejected too)?

It is not clear if they are going to initiate a name check again. This could be associated with when your fingerprints get invalidated. If they initiate a fresh fingerprint (for what ever reason) without refreshing the existing one, that could trigger a name check. So that could be why they have a secondary check on preadjudicated cases.

Hi,
is it absolutely safe to travel with pending i 485 app with valid h1b stamping with receipt notice and completed fp.?we are kind of confuded whether to plan for the travel...We have not yet received the actual advance parole. i read somwhere that if u leave the country wth pending i 485 but without ap ur appl is considered abandoned.is this true.?..we have the option to change the trip to apr too.In a nutshell is it completely safe to travel on 485 pending appl without ap with valid stamping.?:confused:
Has any1 wth the same situation has gone and come back without any issues?

Whats your PD? If you are on H1, have a stamping and already have the 485 receipt, the only possible issue with travel is if your 485 gets approved when you are abroad. People have still managed to enter on H1 as PoE officer apparently does not realize about your 485 approval.

If its a recent PD, then no issues, you can travel (Actually my lawyer told me I can travel even without getting the 485 receipt, but thats apparently a bit of a grey area)

If you had an approved H1B last, that means that you already are on H1B status as of Oct 01 2006. You can continue to work in US on H1B and get it transfered also. Only when you go out of country then you will have to get new H1B stamped. I also had L1 to H1 change.

The visa officer will surely ask you that "why did you change your status from L1 to H1" So be prepared with a good answer for that.

Hello,

I needed your advise whether i have a case to file an APPEAL to USCIS granting me 1 yr H1 extension (beyond 6th Yr) instead of 3 yr extension.?

Recently my 7th yr extension was approved for 1 year in Jul'09 with petition valid date till june'09 (date in the past) . At the time of filling the 7th yr extension, my I140 was not approved but during the processing of my h1 extension my I140 got approved and i had sent the approval copy along with an RFE i recieved in May'09.

Let me give my case background in details.

* LC applied in oct'07
* I-140 applied in May'08 after LC approval
* 6th yr on H1 ended in June 08
* had to return India since my LC < 1 yr and I-140 was not approved
* Employer based on an attorney's advise suggested to apply my 7th yr extension from India once my LC is one yr old (i.e. Oct'08)
� Mar09- applied 7th yr extension based on Approved LC (> 1 yr old ) and applied I-140
� Apr09- I-140 approved
� May09 � Received RFE on H1 extension, replied along with a copy of Approved I-140 hoping to get 3 yrs extension
� Jul09 � Received approval on H1X extension for 1 year with petition valid till Jun'09 (1 yr extension)

Appreciate your advise on the same.

Hi all,

I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?

What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?

I am confused, its a good offer, and i dont know what to do. pls help..

Before starting the application process for permanent immigration, foreign nationals who enter the United States on non-immigrant visas (NIV) are considered to be here temporarily. The law presumes NIV holders intend to return to their home countries at the end of their stay in the United States. There are many NIV categories &mdash; student visas, business visas, visas for tourism, and investor treaty visas to name a few. While NIV applicants must have the intent to return to their home country, there are a few non-immigrant categories that allow a person to have dual intent, that is, to intend to be here temporarily now but eventually to immigrate. All NIV applicants are required to fill out an application form to the appropriate consular post and submit the DS forms according to the NIV category they are applying. Currently, twelve consular posts are required to use Form DS-160, a Web-based NIV application form that incorporates all of the current NIV forms into one format via the Web site. When an NIV applicant fills out the form, the applicant has the option of uploading a digital photo. Once the form is submitted online, the NIV applicant will receive a confirmation page. The new DS-160 form is required in twelve posts (including Mexican and Canadian posts, Dublin, Hamilton, Hong Kong, and Tripoli), and the DS-160 form advances the NIV process since it is submitted in advance of the interview.

Unfortunately , it is true. I personally know a friend whose I-485 was denied even without issuing any NOID or RFE. Reason, well its very obvious, the underlying I-140 was revoked, even though it was past 180 days. By law, your supposed to get NOID or RFE. but some IOs are ignorant and do not know the AC21 laws properly. So they issue straight denial. The number of cases are few because not many companies revoke I-140 past 180 days. But few companies do and some have to do it. So in these situation yes, chances are that you will get a straight denial and that is why there is thread to lobby efforts to raise some concerns to Ombudsman about these erroneous denials.

The intensity of denials is on rise now and also intensity of 140 withdrawals from ex employers is on rise.

No 1099 needs to be filed by the entity writing the check, if the amount is less than $600. Declare it as "Other Income" (probably with a Schedule "C", please check) on your tax return. Check IRS.GOV and www.investsafe.com/language.html

"I immediately called Ramit. 'You are an international traveler, and you have a passport, so you can go in', I said. Ramit's response was instant: I tried to enter but they said you are not allowed for you don't have an international passport. I am normally not given to immediate emotional reactions, but I couldn't resist this time. I was, to be honest, upset. How can they do this to an Indian, in India? Do a story on TOI or NBT? Do it for print or Online? Call other media friends and colleagues? I simply didn't know how to react. Print would have a better impact, but should I wait that long?"

Kalra didn't wait long. He contacted local authorities and used Facebook and Twitter to get the word out to the Indian community and as expected, HD's actions drew plenty of ire. According to BoingBoing, after a fitting public outcry thanks in part to Kalra's efforts, the operator of the franchise (who ironically is Indian) has axed the policy and apparently now claims it never existed.

Kalra, though, chalks this discrimination up to an age-old mentality of some Indian people. "I have often maintained that we ourselves are our biggest enemies. Our mentality is that of slaves and we think anything is good only if its approved by foreigners, or the 'holders of international passport[s].'"

There is nothing tricky, it is plain and simple: you want to switch jobs?
You have to apply for a new H1. You absolutely cannot use your current H1 to work any other job.

Hello,

First of all, I really appreciate your efforts to help people in their immigration issues.

Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.

Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?

You need to go out of US, preferably to your home country, get an H1-B stamp on your passport, and reenter US using your H1-B visa stamp.

I was going through the processing times bulletin which they normally release around 15th of every month and noticed that though date at top says (Posted: September 28, 2008 ) but before the list starts they have written
.................Service Center Processing Dates for Nebraska Service Center as of: July 31, 2008.

Now what is that, have they lost track of dates being considered as of today.............. I can understanb things might standstill for I-485 (dues of non availability of visa numbers), but what about I-140, for last few months it does not jumpout of that March shell.

Also what do they mean by as of July 31, 2008, can we not know someohow as of October 8th or September 28th, what cases are they considering .

I am currently on H1B, which was recently approved under cap exempt for a non-profit employer.But, now I 'd like to work for a profit employer ,which comes under quota .So, can't I change to this new capped employer by filing a new petition at this time where there is no quota available or should my H1B be counted against cap once in the six years period to be able to change employers whether they are profit or non-profit employers? I also would like to know an answer to this question. can I go to school once my 485 is pending for more than 180 days, provided I have 140 approved? If my 485 approval comes whle I am still in school, what would it mean in terms of any complications?
would really appreciate someone throwing light on it.

Hi,
I am having my H1, and applied for renewal hopefully i will be getting it by this Dec '10.

Till Sep 2011 my H1 is valid, after that i am planning to go for extension as i filed my I-140 now.

Next year i am going to India i will get it stamped there for me also for my wife. But due to health reason for my wife, i am planning to stay in India and go for the treatment. For that i have to stay there and assist her fully, for the treatment. Not sure how long it will take.

My question is this, if my employer/client is OK with this, what is the maximum period i can stay in India without working in US.

Two scenarios here:
1. If the pay-stub is not generated, how long i can stay there?
2. If my employer agrees to pay the salary for those months, because i can also work in my company's offshore office, in that case how long i can stay there?

Just fill out the new I9 Form with your EAD details. You should be fine.
